5. Service Terms
5.1 Acceptance of Terms
By accepting the quote—whether verbally or in writing—and upon Capital Stair Services Ltd (hereafter referred to as "The Company") commencing services, all parties agree to be bound by these Terms of Service.
5.2 Regular Stair Cleaning
The Company will provide regular stair cleaning at the frequency specified in the agreed quote (weekly, fortnightly, or four-weekly). Services include:
- Lifting of all door mats
- Sweeping (or hoovering) of all stairwells, landings including front entrance, back passages, and basement (if applicable)
- Wet mopping
- Dusting of handrails
- Removal of cobwebs within reach
Cleaners will not move large or heavy objects (e.g., bicycles, furniture) and reserve the right not to clean areas affected by bodily fluids, medical or drug-related paraphernalia, or excrement. These issues must be addressed before the scheduled cleaning or arranged as a special service at an additional cost.
A sign-off sheet will be posted at the door entrance notifying residents the cleaning has been completed for that visit.
5.3 Deep Cleaning Services
The Company offers a comprehensive deep cleaning service for tenement buildings, which includes:
- Cobweb removal and dusting of all walls, pipes, doorways, and wall fixtures
- Washing of low-level walls up to two meters high
- Washing and dusting of banisters, railings, and stair strings
- Hoovering all floors and stairways
- Mopping all floors and stairways
- Cleaning of front doors and windows
- Sanitizing all communal hand contact points, including handrails and doorknobs
Important Notes:
- This service does not include machine cleaning of floors, which can be quoted separately if required
- While every effort will be made to achieve the highest standard of cleanliness, The Company does not guarantee the removal of ingrained dirt or stains without specialized equipment
- If any additional cleaning requirements or specifications are not listed above, these must be communicated to The Company in advance. Any such services will need to be agreed upon and quoted separately before commencement of the cleaning
Discount for Regular Cleaning Transition:
- A forty percent (40%) discount is applied if deep cleaning transitions to regular cleaning
- If regular cleaning is canceled within twelve (12) months, the discounted amount will be reclaimed through an invoice
5.4 Access to Property
Keys should be provided to ensure access for cleaning operatives. These will be securely stored and returned upon termination of the agreement. If access is not provided via keys, cleaners will attempt entry via the buzzer system. If unsuccessful, cleaners will make a second attempt. Failure to gain access will result in the service being charged for that week.
5.5 Unplanned Obstructions
If cleaning cannot be completed due to unplanned obstructions (e.g., redecorations, repairs) not notified to The Company at least 48 hours in advance, the service will still be charged for that week. Rescheduling or suspending cleaning without charge is possible with more than 48 hours' notice.
5.6 Payment Terms
Invoices are issued monthly or quarterly as agreed. Payment is due within 30 or 90 days of receipt. Overdue payments beyond 60 days may incur an administration fee of up to £40.
5.7 Complaints
Complaints should be reported within 24 hours of service completion due to the nature of communal spaces. The Company aims to address and resolve complaints within 48 hours.
5.8 Invoicing Options
Option A: Invoices are sent to the lead resident managing the tenement's maintenance account.
Option B: Individual invoices are sent to each flat, divided equally plus an admin fee to cover the cost of setting up and administering separate accounts for each flat.
5.9 Non-Participating Flats and Service Allocation
a. Owner Responsibilities under the Tenement Management Scheme
Under the Tenement Management Scheme (Scotland), all property owners in a tenement are jointly responsible for maintaining and cleaning the communal areas of the building, including stairwells, handrails, and communal spaces. Non-participation in the cleaning service does not exempt owners from their legal obligations. Owners who opt out must ensure alternative arrangements are made to uphold the cleanliness and safety of communal areas. Failure to maintain these shared spaces may lead to disputes with other owners or potential enforcement actions under relevant regulations.
b. Majority Participation Requirement
The Company will continue communal cleaning services as long as the majority of flats in the building contribute to the cleaning service costs. Flats that do not contribute will not receive cleaning services, and visits will not be made on their behalf.
c. Service Schedule
A cleaning schedule will be issued to all flats, indicating the specific flats on whose behalf visits will be made. The schedule will clearly outline the dates of cleaning visits and specify which flats are covered under the service agreement.
d. Handling Non-Participating Flats
Non-participating flats may make their own alternative cleaning arrangements during their scheduled turn. The Company will not be responsible for coordinating or enforcing cleaning services for non-participating flats.
e. Transition for New Occupants
When a flat previously under agreement changes occupancy, The Company will send a letter addressed to "The Occupier" outlining the terms of service and the first invoice for the period. The flat will remain part of the cleaning schedule unless the new occupants notify The Company of their decision to opt out.
f. Service Adjustments
The frequency of cleaning visits (weekly, fortnightly, or monthly) will be based on the agreement of the majority of participating flats. If a participating flat cancels their service mid-term, the cleaning schedule will be adjusted accordingly, with affected visits omitted.
5.10 Insurance and Liability
- We maintain comprehensive public liability insurance (£1,000,000) and employers liability insurance (£10,000,000) as evidenced by our current certificate of insurance.
- Our liability for cleaning services is limited to re-cleaning or refunding the cost of the specific service.
- We are not liable for pre-existing damage or for damage caused by factors beyond our reasonable control.

10. Variation
Capital Stair Services Ltd. shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the services and/or any page of this Website.
11. Invalidity
If any part of the terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the terms and conditions will not be affected.
12. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Scotland and you can bring legal proceedings in the Scottish courts. If you live in one of the countries of the European Union, you can also bring legal proceedings in the local courts of your country.
